Terms of Service

1. Parties and acceptance

These Terms of Service ("Terms") are between Sunbelt Drayage, LLC ("Sunbelt Drayage," "we," "us," or "our"), a Houston, Texas-based motor carrier operating under USDOT 3989210 and MC-1496015, with its principal place of business at 16140 Waverly Dr, Houston, TX 77032, and any individual or company ("Customer," "you") that requests, books, or uses Sunbelt Drayage's container drayage, storage, intermodal, or related trucking services, or that uses this website.

By requesting a quote, tendering a load, signing a rate confirmation, or otherwise using our services or this website, you agree to be bound by these Terms. If you do not agree, do not use our services or this website.

2. Quotes and rate confirmations

Any rate shown on this website, quoted by email, or quoted by phone is an estimate only and is not a contract or a binding offer. A binding agreement to move a shipment exists only once Sunbelt Drayage issues a written rate confirmation and it is accepted by the Customer. Where a quote and a signed rate confirmation or customer agreement conflict, the signed document controls.

Quotes are valid for 7 days from the date issued unless a different validity period is stated in writing. Quoted rates do not include accessorial charges, which are billed as incurred and may include, without limitation: fuel surcharge, chassis usage, pre-pull, container or chassis storage, detention and waiting time, layover, chassis split, port or terminal fees, tolls, and per diem.

3. Customer responsibilities

Customer is responsible for providing accurate shipment weights and commodity descriptions, ensuring loads are legal for over-the-road transport, and providing accurate appointment and delivery-site information. Customer is responsible for managing free time at the terminal and at the delivery or receiving location.

Demurrage, detention, per diem, and storage charges are billed to and payable by Customer regardless of the cause of the delay, unless the delay was caused solely by Sunbelt Drayage's negligence.

4. Prohibited freight

Sunbelt Drayage does not transport hazardous materials as defined in 49 CFR Parts 100–185. Any hazmat endorsement held by a Sunbelt Drayage driver is maintained solely for TSA/TWIC background-check and credentialing purposes and does not indicate that Sunbelt Drayage accepts hazardous material shipments.

Sunbelt Drayage may refuse, reject, or return any shipment that is found to contain or constitute hazardous material, at Customer's expense, including any accessorial, storage, disposal, or handling charges incurred as a result.

5. Cargo liability

Sunbelt Drayage's liability for loss of or damage to cargo while in its care, custody, and control is limited to $100,000 per shipment, unless a higher value is declared by Customer in writing prior to pickup and accepted by Sunbelt Drayage in writing. Sunbelt Drayage is not liable for consequential, incidental, special, or punitive damages, including lost profits or lost sales.

Cargo claims must be submitted in writing within 9 months of delivery, or within 9 months of the date the shipment should have been delivered. Disputes concerning damage to a container or chassis are governed by the Uniform Intermodal Interchange and Facilities Access Agreement (UIIA) and the applicable interchange record.

6. Payment

Invoices are due net 30 days from the invoice date unless different credit terms have been agreed to in writing. Amounts not paid when due accrue interest at 1.5% per month (or the maximum rate permitted by law, if lower). Customer is responsible for all reasonable costs of collection, including attorney's fees, incurred in collecting past-due amounts.

7. Limitation of liability and indemnity

Except as expressly stated in Section 5, Sunbelt Drayage's total liability arising out of or related to its services is limited to the amount actually paid by Customer for the shipment giving rise to the claim. Customer agrees to indemnify and hold Sunbelt Drayage harmless from claims, damages, and expenses arising from Customer's inaccurate shipment information, prohibited freight, or breach of these Terms.

8. Dispute resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. The exclusive venue for any dispute arising out of or relating to these Terms or Sunbelt Drayage's services is the state and federal courts located in Harris County, Texas, and each party consents to personal jurisdiction there.

Each party waives any right to a trial by jury and any right to bring or participate in a class action, collective action, or representative proceeding. Claims must be brought individually and not on behalf of, or combined with, any other person's claim.

9. Website use

We aim for the content on this website, including port wait-time information, to be accurate and current, but we make no warranty as to its accuracy or completeness. Wait-time data displayed on this site is informational only and is measured from Sunbelt Drayage's own fleet activity; it is not an official terminal metric and should not be relied on as such. You agree to use this website only for lawful purposes and not to interfere with its operation or security.

10. Changes, severability, entire agreement, contact

We may update these Terms from time to time; the effective date above reflects the most recent revision. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. These Terms, together with any applicable rate confirmation or signed customer agreement, constitute the entire agreement between the parties regarding their subject matter.
